TERMS OF SERVICE

These Terms of Service (“Terms”) form a binding agreement between you and Stackd Systems LLC (“Stackd,” “we,” “us,” or “our”). These Terms govern your use of the Stackd mobile application, website, and all related services (collectively, the “App”).

By creating an account, linking a bank account, initiating a transfer, or using the App, you agree to these Terms and consent to the processing of your information as described in our Privacy Policy.

If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 18 years old, a resident of the United States, and legally able to enter a binding contract. You must have a U.S.-based bank account to use Stackd’s savings and transfer features.

2. Overview of the Service

Stackd helps users build savings habits by logging actions, creating goals, and initiating transfers from a primary checking account to a designated savings account.

Stackd is not a bank, financial institution, money-services business, broker-dealer, or financial advisor. All money movement is performed by regulated third-party partners.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for safeguarding your login credentials and all activity occurring under your account.

We may suspend or terminate your account for suspected fraud, unauthorized activity, KYC failures, violations of these Terms, or compliance requirements imposed by our financial partners.

4. Third-Party Financial Providers

4.1 Plaid (Bank Connectivity)

When you link a bank account, you do so through Plaid Inc., which securely transmits account information to Stackd and our payment partner.

By connecting a bank account, you authorize Plaid to access and transmit your account data.


You acknowledge that Plaid’s services are subject to Plaid’s End User Privacy Policy:

Stackd does not receive or store your bank login credentials.

4.2 Dwolla (Money Movement)

Funds transfers are provided by Dwolla, Inc. (“Dwolla”).

By creating a Stackd account, you also create a “Dwolla Customer” account.

You agree to Dwolla’s Terms of Service and Privacy Policy:

You authorize Stackd to share your personal information with Dwolla for identity verification and compliance purposes.

If Dwolla cannot verify your identity, your ability to use Stackd’s financial features may be limited or revoked.

5. Identity Verification (KYC)

To comply with U.S. regulations, we must verify your identity before enabling transfers.

You authorize Stackd and Dwolla to collect and verify information such as:

  • Name

  • Date of birth

  • Address

  • Phone number

  • Email

  • Last 4 digits of your Social Security number

  • Bank account details (via Plaid)

Additional documentation may be required.

6. License to Use the App

Stackd grants you a limited, personal, non-transferable, revocable license to use the App. 

You may not:

  • Copy, modify, or distribute the App

  • Reverse-engineer the App

  • Interfere with security or network operations

  • Use automated tools (bots, scrapers)

  • Use the App for illegal or fraudulent activity

7. Data and Information Use

By using the App, you authorize Stackd and its service providers to collect, use, store, and process your information, including financial, behavioral, and device data, as described in our Privacy Policy.

This includes data related to actions you log, savings activity, streaks, badges, engagement, and app interactions.

8. Savings Actions and Behavioral Features

The App provides motivational and informational features, including:

  • Daily or weekly actions

  • Streaks

  • Savings goals

  • Progress visualization

  • Badges and achievements

These features are for habit-building only.

Stackd does not guarantee savings outcomes or financial improvement.

9. User-Generated Content

You may create or submit content in the App (“User Content”). You grant Stackd a nonexclusive, worldwide, royalty-free license to store, display, reproduce, modify, and distribute your User Content solely to operate and improve the App.

You are responsible for ensuring that your User Content does not violate any laws or infringe any rights. We may remove or restrict User Content at any time.

10. ACH Transfer Authorization

By using Stackd’s savings features, you authorize Stackd and Dwolla to initiate ACH debits and credits to and from the bank accounts you link through Plaid.

This authorization applies to:

  • One-time transfers

  • Recurring transfers

  • Scheduled transfers

  • Transfers triggered by actions you log (“Save $X”)

You certify that you are an authorized user of the bank accounts you connect.

Revoking Authorization

You may revoke ACH authorization at any time by disconnecting your bank account, deactivating your Stackd account, or contacting us.

Revocation does not cancel transfers already in progress.

Transfer Timing and Delays

ACH transfers typically take 1–3 business days. Transfers may be delayed, reversed, or rejected due to insufficient funds, compliance review, bank restrictions, or network issues.

ACH Returns and Liability

You are responsible for any fees or losses caused by:

  • Insufficient funds

  • Invalid account details

  • Unauthorized use of your account

  • Transfer reversals or returns

11. Fees

Stackd may charge fees for certain services. Any applicable fees will be disclosed in the App before they apply. Fees charged by Dwolla or Plaid for bank linking or funds transfers may also apply.

12. Account Deactivation

When your account is deactivated:

  • Connected bank accounts will be disconnected

  • Pending transfers may be canceled or allowed to process

  • Certain data may be retained for legal or compliance purposes

  • User Content may be retained or deleted per our Privacy Policy

We may suspend or terminate accounts to comply with legal, regulatory, or risk-management requirements.

13. Prohibited Conduct

You may not use the App to:

  • Engage in fraud or money laundering

  • Circumvent identity verification

  • Trigger transfers without sufficient funds

  • Manipulate app features

  • Upload illegal or harmful content

  • Use automated scripts or bots

  • Interfere with the App’s functionality

Illegal activity may be reported to authorities.

14. Third-Party Services

The App relies on third-party providers, including Plaid and Dwolla.

We are not responsible for:

  • Service interruptions

  • Errors or delays caused by third parties

  • Inaccurate or incomplete financial data supplied by third parties

Your use of these services is governed by their respective terms.

15. Risks of Using the App

You acknowledge and agree that:

  • Financial transfers carry risk

  • Savings outcomes depend entirely on your actions

  • Data accuracy depends on your bank and Plaid

  • Projections and goals are estimates only

  • Past savings behavior does not guarantee future performance

16. No Financial Advice

Stackd does not provide financial, investment, tax, or legal advice.

All decisions regarding transfers, savings, and financial behavior are solely your responsibility.

17. Disclaimer of Warranties

The App is provided “as is,” without warranties of any kind, whether express or implied, including warranties of:

  • Accuracy

  • Reliability

  • Performance

  • Fitness for a particular purpose

We do not guarantee that the App will be error-free or uninterrupted.

18. Limitation of Liability

To the maximum extent permitted by law:

  • Stackd is not liable for any indirect, incidental, special, consequential, or punitive damages.

  • Our total liability to you will not exceed the amount you paid to Stackd, if any, in the 12 months before the claim arose.

19. Indemnification

You agree to indemnify and hold Stackd, its officers, directors, employees, partners, and service providers harmless from any claims arising out of:

  • Your use of the App

  • Your financial transfers

  • Your User Content

  • Your violation of these Terms

20. Electronic Signatures and Communications

By using the App, you consent to:

  • Entering agreements electronically

  • Receiving disclosures and notices electronically

  • Receiving transfer confirmations and communications electronically

You may withdraw consent by stopping use of the App.

21. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to conflicts of law.

Any dispute arising from these Terms or your use of the App will be resolved through binding arbitration, except where prohibited by law.

22. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated through the App. The effective date at the top reflects the latest update. Continued use after updates constitutes acceptance.
